Fitness to plead & capacity

This type of assessment is used to establish whether, from a mental health perspective, an individual has the capacity to understand the proceedings with which they are involved and if they are fit to stand trial. To be declared fit to plead or stand trial from a mental health aspect they need to be able to:

  • Understand the nature of the offence for which they are on trial or the nature of the proceedings
  • Understand the evidence
  • Be able to provide advice to their elected legal team and understand the advice they are being given.
  • Understand the legal process, i.e., the role of the judge, the barrister etc.

Many of our Experts are able to undertake capacity assessments and assessments of fitness to plead at short notice. A Capacity Certificate can be completed and provided within 24 hours of an appointment if required.
